Can Suspected Fathers Be Forced to Submit to a Paternity Test In Florida?

Posted On: June 21, 2022

Under Florida law, paternity must be established when two unmarried parents separate in order to collect child support or have custody and visitation with the child. However, some suspected fathers may not want to submit to a paternity test. They may have no desire to share in the responsibility of a child, even if that child is biologically theirs.

Legally, both parents must financially support their children. In cases like these, Florida allows for involuntary paternity testing. Here’s what you need to know about it and how Sparkman Law Firm can help.

Involuntary Paternity Testing Explained

The mother of a child can seek involuntary paternity testing by filing an application with the court. A hearing will scheduled and the suspected father must either assume paternity at the hearing or the judge will order a paternity test. If the suspected father does not submit to the test, he may be held in contempt of court. If the test is a match, the child’s father will then be ordered to pay child support according to his income.

Fathers Rights Under Florida Law

Experts have long recognized the benefits of children having meaningful access to both parents. Ideally, both parents will be involved in the child’s life, both physically and financially. However, a fathers who has submitted to an involuntary paternity test may not automatically be granted parental rights even if the test is a positive match, particularly if the father had no intent to support the child and was forced by the court to submit to paternity testing.

A father who is a confirmed match can submit an application to the court for time-sharing privileges and legal rights to his child. However, this process can be complex and generally requires the expertise of a seasoned Florida family lawyer.
